Miguel Sano accused of assault by photographer

She made it very clear she was seeking neither. She was just telling her story.

 

Right, but what we were talking about is the claim that she certainly has the right to do things on her own timeline and in her own way, which is true except if she is filing civil or criminal charges then statue of limitations would apply.

Not only that with all the media, security and staff around if she was truly screaming at the top of her lungs for ten minutes while fighting him outside a public restroom as she claims there is NO WAY in hell that someone didn't hear this taking place and didn't respond. On top of that if Sano did try and assault her and rough housed her trying to get her into a bathroom why didn't she file a criminal report with police the day the alleged event occurred?  I'm sorry if some guy assaults you and attempts to rape you in a public restroom you call the police and report him.  I don't care what anyone says I just don't buy this story the way it's currently being told.  

About fifty years ago, a factor in determining whether a sexual assault occurred was how much the victim had resisted.  As you suggest, if she didn't fight hard enough, or people weren't alerted who were nearby, there could be no sexual assault.  Thank god, our law has progressed from that point, and no longer considers such factors.

But she's not filing a claim, so the statute of limitations doesn't apply.

I agree with this. Once she posted on social media and named names, she lost control.

 

Personally, I wouldn't post something like that on social media for all to see.  The only reason to do something like this in the fashion she did is for some ulterior motive, dare i say blackmail.

 

If someone "sexually assaults" you as she initially claimed, rough houses you for 10+ minutes, then attempts to drag you into a bathroom to likely rape you, meanwhile you fight him the whole time, screaming at the top of your lungs the whole time for help, etc., I HIGHLY doubt you would run to social media instead of the police.  If it was really as bad as she says it was then she should have filed a police report IMMEDIATELY and filed a civil suit against him.  If the Twins scoffed at it she should have told them to go to hell and done it anyways.  If her story is true.  

 

By the way in that CBS piece it states that Twins Daily has been stripped of most of their access.  What is that all about?

Actually that's not what I was saying at all.  What i'm saying is that if she was in fact "sexually assaulted" no exaggerations, she should have reported it to police immediately because by going the route she is going Sano will get a slap on the wrist and could do it again.   And by slap on the wrist i mean no civil or criminal charges.

 

This is why i don't believe her story the way she told it and that is my right.  Do not put words in my mouth again.  Maybe you believe it's okay for an individual to throw around allegations for the hell of it and that the alleged perpetrator is automatically guilty, but that's not how the laws in this country are written.  You should also know that in this country if someone makes a false claim against another individual they are subject to defamation action. 

 

Maybe you think it's okay that Sano did what he did to her as long as she posts what happened on social media, but i don't like it. If your sexually assaulted you should report it to police immediately.

I don't know how it's more believable that a young women who's career depends on sports connections would make up a story with such detail who stands to gain nothing, but stands to lose career opportunities and have their character thrown in the mud, than it is for her story to be largely true, perhaps at worse, her recollection colored by the trauma of the experience.

She's not a college student, nor a young woman.  In fact she's only 2 years younger than you.  She also works as a free lance photographer / writer and has high visibility online.  Why would her character get thrown in the mud if this is true?

 

She can also gain a ton if this is true (and rightfully so) including huge settlement payments from the Twins and or Sano.  "Stands to gain nothing," in her scenario this is flat out not true and you know it.  Oh and traumatic events such as this often times are the hardest to forget.  Do you know why drill sergeants used to slap fresh recruits?  So they would remember.

Coming from someone who has likely never been a victim of sexual assault. You said in an earlier post that you didn't want another poster to put words in your mouth, I'd suggest you stop projecting feelings, motivations and internal conflict onto someone else, someone who you can't possibly relate to in any way.

Some that want to see Sano suspended harshly are going to be disappointed.

I'm not sure how you can draw that conclusion from the article. We don't know how MLB will handle this. The fact there's no civil or criminal law suit, may work against Sano, as this investigation is the only one that could bear consequences for Sano. At this point, I don't think there's any way of knowing how MLB will come down on Sano, if they will at all.

Well, towards the end the article insinuated that what Miguel is accused of is less severe than several recent cases.  So that may be part of the reason to think that.

 

However, it also acknowledges what you said - that we're in unknown territory.  I expect some kind of punishment, but I don't think it will be "severe".

It depends on what their investigation turned up, and not sure if all that is made public. But if all it is is a ‘he said, she said’ not sure what the outcome will be.

That's correct in a strict legal sense, however there are legitimate reasons to be concerned about too many people picking up their torches and pitchforks based on unsubstantiated allegations on social media.

 

You are entitled to due process in a court of law.  In the court of public opinion, the Twitter Mob can be judge, jury and executioner, fairness and truth be damned.

 

And while judgments of the Twitter mob have no legal force, they can certainly have consequences to the people they are handed down against.  (The professor who was falsely identified as one of the Charlottesville marchers for example).  

 

So no, it's not illegal to believe or disbelieve whatever tweets you want.  But that doesn't mean rushing to join the mob is the right thing to do.
