USDA regulates US Farm agriculture products. There are laws that regulate these types of things in the US, including the tolerances of fat to lean in ground beef (80/20 can be 81/19 or 79/21 for instance) but it does not regulate Wagyu claims. Wagyu is Japanese agriculture.

I spent over 6 years near Tokyo. They sold a mixture of quarter horse and the beef you're talking about.

 

Called it "Wagyu and the horse you rode in on."

 

Big seller.

This is true.  Japan could regular that though too, couldn't they?  

 

Bourbon and Scotch are lawful labels that must meet certain requirements.  Why not wagyu burgers?

Bourbon is regulated by the ATF in the US, not outside the US. Someone could (and probably does) buy a crapload of Bourbon, blend it off with ethanol and water, and label it as Bourbon again. This type of thing happens all over the world in countries that don’t protect Ip. It’s very rare to hear of ATF raids on material being imported into the US, but it happens (before clearing customs)
 

Scotch, Bourbon or Wagyu, if it’s surprisingly cheap, it’s probably not as advertised

I don't doubt that any of that occurs.  It's just another form of bootlegging.
