One if it's a park, recreational use statutes usually grant immunity for all but gross negligence. Two, trees aren't open and notorious dangers (like open pits) that landowners owe a duty to invitees to warn against. I can't believe a lawyer took their case; maybe on the off-chance the park owner wants to settle to avoid bad publicity...

And that air is nitrogen gas, not only to prevent breakage but to keep them from spoiling. Ever wonder why an unopened bag of chips virtually never spoils?
